Alaska Public Offices Commission to hear complaints

Democrats find this kind of ad "chilling"

Among cases scheduled to go before the APOC commission next week include a proposed settlement with Rep. Bill Thomas, R-Haines, and supporters, who had faced a complaint over thank-you ads, paid by local businesses, in support of Thomas.

The ads, which read, “Thank You,” were coordinated by Jim Studley and appeared over several weeks in the Chilkat Valley News.  A few of the ads mentioned voting for Thomas, and APOC has determined that those ads were in violation of APOC regulations.  Read more->

On November 19, 2010 the Alaska Public Officer’s Commission held a hearing regarding the complaint filed against Haines businesses by Anchorage blogger Linda Kellen Biegel. Biegel alleges some members of the Bill Thomas campaign arranged a series of election advertisements in the Chilkat Valley News supporting Thomas, in violation of APOC rules.

An APOC staff report issued on November 5 concluded that the “thank you” ads that did not use the word “vote” were not regulated campaign speech, and therefore only two ads that also contained the word “vote” are in question. Their recommendation was that the two businesses that posted those ads be fined $50 each, with the fines effectively reduced to zero due to mitigating factors–the newness and unfamiliarity of the law, and staff errors resulting in Mr. Studley receiving erroneous advice.
