Federal Court Dismisses Miller Lawsuit
Election will be officially certified Thursday by Gov. Sean Parnell

ANCHORAGE–A judge today dismissed Republican Joe Miller’s federal lawsuit seeking to overturn the results of the Nov. 2 election, clearing the way for U.S. Sen. Lisa Murkowski to be sworn in for another term.

U.S. District Judge Ralph Beistline issued a 14-page order in which he said Miller wasn’t raising any federal issues that he needed to resolve. Beistline wrote that he would not second guess the Alaska Supreme Court, which already had ruled against Miller. He ordered Miller’s entire federal case dismissed.

U.S. Senate candidate Joe Miller says he will go forward with the federal lawsuit that was filed last month, and will ask the court to stay the post certification election contest timeline until after the federal case has concluded.

He will not, however, ask that the state’s certification of election results be delayed, thus allowing Sen. Lisa Murkowski to be seated in January.   Read more->

Miller Reaches End of the Trail in State Court

FAIRBANKS–The Alaska Supreme Court issued a ruling earlier today denying both Joe Miller’s appeal and Lisa Murkowski’s cross-appeal, affirming various decisions of the Division of Elections that the candidates had challenged.

“We disagree with the court’s intrepretation of the election code, but respect both the rule of law and the court’s place in the judicial system,” Miller said. “We are studying the opinion and carefully considering our options.”

The U.S. District Court for the District of Alaska also issued an order, for Miller to submit a brief regarding his federal claims by this Monday, December 27, and directed the State to file a response by the following Wednesday. Read more->

Preliminary Election Returns
Voters turn out despite hard rain and blustery weather

HAINES — Election day arrived with rain and breezy weather.  About noon the wind switched around to southeast; by 3:00 p.m. it was gusting to about 50 mph in town.  Eldred Rock Lighthouse weather instruments showed steady wind at 44 mph with a maximum gust speed of 90 mph.  (If we were on the east coast, we’d be in the national news.)

ALASKA — Our instinctive response to Senator Lisa Murkowski’s choice to run against Joe Miller and Scott McAdams as a write-in candidate for the U.S. Senate seat she now holds was to wring our hands and ask, “What is she doing?  She’s splitting the conservative vote.  The Democrat could win.”  But in politics things are not always what they appear on the surface. ANCHORAGE — In another stunning upset that seems to characterize this year’s elections, Fairbanks attorney Joe Miller has won the GOP primary race against Lisa Murkowski.  According to a KINY news flash, “Murkowski told reporters at her Anchorage campaign office this evening (Tuesday) that after today’s count of absentee ballots, there appears to be no way for her to make up the vote difference and overtake Miller.”

And in an email released from the Miller campaign, Joe Miller reports ”Earlier this evening, I received a call from Senator Murkowski honorably conceding the race. I want to thank her for a hard fought contest.” Read more->

HAINES — Lisa Murkowski is coming to Haines for a meet & greet fundraiser at the Bald Eagle Foundation on Friday from 4-5 pm. Afterward, the senator will visit the Elks during the hamburger feed, then make a short visit to the assisted living facility.

Murkowski is Alaska’s senior senator, first appointed to the U.S. Senate in December 2002, reelected in 2004, and is running for reelection again this fall.

She currently holds positions on several Senate committees including Appropriations; Health, Education, Labor & Pensions; Energy & Natural Resources; and Indian Affairs.
