OPINION: Thoughts on the Haines Borough Election

The voters have spoken, and all of the borough assembly races have been decided. This race was marked by a certain symmetry–a conservative and a liberal candidate running for each seat. For voters on either side of the fence, the choice was clear.

Our hats are off to the political strategists on the left. With the mayor and all assembly seats but one on the ballot for either election or recall, they nearly achieved a clean sweep. Read more->

Haines Recall Committee Still on Track
“This recall is about making the assembly follow the law…”

Haines Recall Committee chairman Jim Shook reports that as of Tuesday morning, the petition sponsors had gathered 268 signatures. With 3 days to go until the “drop dead” date, it looks like the issue could make it onto the October 4 municipal ballot.

In order to be certified, the petition must have 275 valid signatures.  The committee’s target is 300 signatures as a safe margin in case some of the signatures are duplicates or otherwise disqualified.  Though the signature gathering seemed to slow over the weekend, the committee has redoubled its efforts during the past few days.  Read more->

Haines Recall Effort Moves Ahead

In less than 2 weeks, the Haines Recall Committee has gathered 186 signatures on petitions to recall assembly members Daymond Hoffman and Joanne Waterman. Committee members have 60 days to gather 275 signatures, which would then trigger a recall election.

According to committee chairman Jim Shook, the group is interested in having the issue on the October 4th municipal ballot, rather than making the borough and its voters go through another special election.  To do this, the completed petitions would need to be submitted to the borough clerk no later than August 12–just 9 days away.   Read more->

How the Haines Borough Assembly gathers power at expense of voters

HAINES–One month ago the Haines Borough Assembly violated state statutes and borough ordinances when they decided to leave Assembly Seat E vacant for the rest of the year until election time in October.  Those present at the meeting were alarmed by the actions of the assembly, and by their disrespect toward the public, and we wrote about it here in the Haines Alaska News.

For obvious reasons, it would make sense to appoint Karen Hess to the vacant seat until the October election, however three assembly members are politically opposed to seating Hess, offering to seat nearly any other member of the public instead.  Members Rossman and Lapp stood steadfastly behind Hess.

When the Assembly decided they were deadlocked and there was no way forward, they “compromised” by agreeing not to fill that seat until the October election.  In reality, this was no compromise at all — just an agreement to shirk their duty to Haines voters by not doing the job required by law.  Read more->

Last Monday’s Haines Borough Assembly special meeting made a mockery of our election ordinances, the will of the voters, the rule of law, the authority of the superior court, and common decency.

Most of the public present favored seating Karen Hess in the vacant assembly Seat “E”, including assembly members Scott Rossman and Jerry Lapp. But in a clearly partisan move, members Daymond Hoffman, Joanne Waterman and Steve Vick refused to seat Hess, offering instead to seat almost any other member of the public.

Their actions mirrored those at last fall’s assembly meeting in which they voted to seat Greg Goodman in spite of his residency issues: the three obviously arrived prepared not to seat Hess under any circumstances, and then groped in vain for facts and logic that would justify their actions. Half of the audience walked out before the meeting was over, and comments by some caused a couple of assembly members to complain about being called “spineless,” and “prejudiced” by the public. Statesmanship and the Haines Borough Assembly
Two wrongs won’t make things right.

When the Alaska Superior court ruled against the Haines Borough Assembly in the Karen Hess case, it was a wakeup call–not only to the assembly–but to every citizen in Haines who values the rule of law over political partisanship. HAINES–The Haines Borough Assembly met in executive session Tuesday evening to discuss the Hess vs. Haines Borough case.  Upon returning to regular session, the assembly passed a motion to follow the borough attorney’s advice and appoint a person to the Assembly seat “E” until the regular borough election in October.  Read more->

Between a Rock and a Hard Place
The next borough meeting promises to be anything but routine…

HAINES–Now that the court has overturned the decision of the Haines Borough Assembly to seat Greg Goodman in spite of his eligibility issues, the devil will be in the details.

The Juneau Superior Court has ordered that Assembly Seat “E” be declared vacant, and that a special election be ordered to fill the vacancy. But borough code makes compliance with the court order difficult, at best.  Read more->

HAINES–In a long-awaited ruling, Judge Phillip Pallenberg ruled yesterday in favor of Karen Hess, reversing the Haines Borough Assembly’s decision to seat Greg Goodman in spite of his failure to comply with residency requirements when he ran for election last year.

Update: Hess vs Haines Borough & Greg Goodman

HAINES–Karen Hess’s attorney reports that the case is “good to go,” and will likely be ready for a decision beginning February 16th.

Hess has appealed the Haines Borough Assembly’s decision to seat Greg Goodman without completing the investigation into his residency issues as required by borough ordinance. The delay in this case has been the result of civil filings and procedures that allow time for the other party to respond. The saga continues…

HAINES–The appeal of contested election continues to work its way through the court system, albeit rather slowly, as required by court procedures. Since folks have been asking, here is another update:

On December 23rd, a Stipulation Regarding Procedure and Briefing Schedule was filed with the court, signed by the attorneys for Hess and for the Haines Borough.

In the stipulation, both parties agree that the case is both an appeal from a decision by the Haines Borough Assembly concerning the municipal election on October 5th, as well as separate and independent causes of action.  The appeal portion of the case will be handled first.   Read more->

We’re Still Waiting
Hess vs. Haines Borough and Greg Goodman is still proceeding…

HAINES–On December 15th attorneys for the Haines Borough and Karen Hess appeared at a status hearing in front of Judge Phillip Pallenberg in Juneau. Karen Hess and Greg Goodman were also present telephonically. Goodman indicated that he has talked to an attorney in Juneau, though that attorney was not present to represent him.

Z. Kent Sullivan, attorney for Hess was given until Monday, December 27, to file a procedural brief with the court, essentially telling the court whether the case should be treated as a contest of election or a civil case. The respondents will have ten days to file a reply.

Contest of Election Appealed
Assembly’s decision for Goodman was “baseless, illegal and ill-advised”

HAINES — A lawsuit filed in Superior Court on November 4, 2010 against the Haines Borough and Assembly candidate Gregory Goodman is asking for damages and injunctive relief, including “a permanent injunction requiring the Haines Borough Assembly to reverse its baseless, illegal and ill-advised decision on October 26 regarding the matter of the contested results for Seat ‘E’.”

The Haines Borough Charter and Code of Ordinances require a candidate for elective office to be a resident of Haines for 1 year immediately preceding the election; Goodman moved to Anchorage where he worked, lived and registered to vote in 2009.  Read more->

HAINES — In a 4-2 decision this evening, the Haines Borough Assembly dismissed the contest of election against candidate Greg Goodman, swearing him in as the new Assembly Member for Seat E.

Preliminary Election Returns
Voters turn out despite hard rain and blustery weather

HAINES — Election day arrived with rain and breezy weather.  About noon the wind switched around to southeast; by 3:00 p.m. it was gusting to about 50 mph in town.  Eldred Rock Lighthouse weather instruments showed steady wind at 44 mph with a maximum gust speed of 90 mph.  (If we were on the east coast, we’d be in the national news.)
